This form constitutes the agreement between the artist and client who's name and address are provided above.
1. The Artist: The artist chosen to produce the commission is Lisa Poulsen of Inspired by Caithness, 4 Burnside, Scrabster, Thurso, Caithness, UK, KW14 7UG.
2. The Concept: The artwork will be in the style of the artist, along the lines of previous work titled ‘StoneScape’ but as there are variations in the creative process the client should expect a unique work. The commissioned artwork will be based on a location(s) of the client’s choosing, within Caithness as agreed with the artist.
3. The Artwork: The artwork will be created using photography and digital processes and will measure approximately 16 x 16” unframed. The finished artwork will be a giclée print supplied in a bright white mount (measuring 24x24") and protective cellophane wrap. This is included in the commission price.
4. Authenticity: Provenance of the artwork will be supplied in the form of a Certificate of Authenticity signed by the artist.
5. Payment Schedule: The total cost of the commission is £750.00. The client will pay a non-refundable 50% deposit of £375.00, payable to the artist prior to commencement of the artwork with the balance of £375.00 payable upon receipt of the work.
6. Completion: The commission will be completed and delivered to the client’s home address on an agreed date and time.
7. Copyright: The artist reserves the common-law copyright to the artwork commissioned by the client, including all preliminary photographs. The artist also reserves all reproduction rights and the right to claim statutory copyright. It is an infringement of copyright for the client to: reproduce the artwork, issue copies of the artwork to public, rent or lend the artwork to public or make an adaption of the artwork. No artwork may be reproduced by the client without the prior written approval of the artist.
8. Exhibition Use: Through mutual agreement between the artist and client, the artist shall have the right to borrow the artwork for exhibition to the public at no expense to the client and without fees imposed on the artist by the client upon proof of sufficient insurance and pre-paid transportation costs. The artist will give the client prior notice if the work is needed for exhibitions or events.
9. Promotional Use: The client hereby grants the artist permission to publish imagery associated with the commissioned artwork. Including, but not limited to, the full commissioning process and completed artwork for promotional and editorial purposes to the benefit of the artist, without violation of the client’s right of privacy.
10. Right of Refusal: In the even that the client does not wish to purchase the commissioned artwork, the client may refuse. In that case, the artist will retain the refused artwork and the non-refundable deposit. This is free of any claims or interests of the client and the client will not owe any additional fees to the artist.
